O prazo para apresentação da declaração do Censo Anual de Capitais Estrangeiros no País se encerra às 18h00 do dia 15/08/2023.
Conforme previsto na Resolução 281/2022 do Banco Central do Brasil (Bacen), a declaração anual é obrigatória para (i) as pessoas jurídicas sediadas no país que, em 31/12/2022, possuíam participação direta de não residentes em seu capital social, em qualquer montante, e patrimônio líquido igual ou superior a US$100.000.000,00 (cem milhões de dólares americanos); e (ii) os fundos de investimento que, em 31/12/2022, possuíam cotistas não residentes e patrimônio líquido igual ou superior ao equivalente a US$100.000.000,00 (cem milhões de dólares americanos).
A partir de 01/11/2023 o CENSO será integrado ao novo sistema SCE-IED.
Ressaltamos que a não apresentação da declaração do Censo Anual de Capitais Estrangeiros no País, bem como sua entrega fora do prazo ou com vícios, poderá acarretar a aplicação de multas pelo Bacen, conforme normas em vigor.
ANNUAL FOREIGN CAPITAL IN THE COUNTRY CENSUS 2023 – DEADLINE EXPIRES ON AUGUST 15TH
The deadline for filing the Foreign Capital in the Country Census report expires on August 15th, 2023, at 6:00 pm.
As stated by Resolution 281/2022 of the Brazilian Central Bank (Bacen), the annual report is mandatory for (i) legal entities headquartered in Brazil that, on December 31st, 2022, had direct interest of non-residents in their capital stock, in any amount, and net equity equal to or greater than US$100,000,000.00(one hundred million American dollars); and (ii) investment funds that, on December 31st, 2022, had non-resident shareholders and net equity equal to or greater than the equivalent of US$100,000,000.00 (one hundred million American dollars).
As of November 1st, 2023, this Census will integrated into the new SCE-IED system.
We emphasize that failure to present the report of Foreign Capital in the Country Census, as well as its delivery after the deadline or with misinformation, may result in fines imposed by Bacen, according to the regulation in force.
